Lord Justice Sedley recently suggested that “deterrence, which is a necessary part of the protection of reputation and arguably of privacy too, is best handled by an independent statutory regulator”. He went on to say that, under such a system, there would be “no serious case for preserving anything of the Press Complaints Commission … except its Code of Practice…”.
